Travel Auction Price Drop Terms

1. About these Price Drop Terms

1.1 About this website. These Price Drop Terms (“Drop Terms”) govern your use of the Travel Auction website and its falling-price offers (each a “Drop”). The website is operated by Booksi LLC, doing business as Booksi Vacations (“Booksi,” “we,” “us”).

1.2 Booksi terms still apply. These Drop Terms add to, and do not replace, the Booksi Terms and Conditions, the offer-specific resort or cruise terms (“Offer Terms”), the Booksi Vacations Refund Policy and the Booksi Privacy Policy. Booksi remains responsible for the travel package and its booking and support arrangements.

1.3 Which terms control. The Offer Terms and Booksi Refund Policy control accommodations, resort previews, eligibility, travel dates, fees, cancellation and refunds. The Booksi Privacy Policy governs privacy. These Drop Terms control only how a Drop is priced, held and purchased.

1.4 Your agreement. By viewing a Drop or selecting Book Now, you agree to these Drop Terms. If you do not agree, do not use the website.

2. How a Drop works

2.1 Fixed-price offer, not a bid auction. Although the website uses the name Travel Auction, a Drop is a descending-price sale. You do not place bids and no one can outbid you. There is one current price; the first Book Now request accepted by our server receives the Hold at that price.

2.2 Starting price. Each Drop opens at the stated Retail Value of the package, as described in Section 5.

2.3 Falling price. The price falls in a straight line, updated every second, from Retail Value to the Drop’s published floor price (“Floor”) over its published duration.

2.4 Our server sets the price. The current price is calculated by our server. Your display may lag because of your connection, device or browser. The applicable price is the server price when our server accepts your Book Now request, not necessarily the last price displayed on your screen.

2.5 Viewing does not reserve. View Deal opens the offer, qualifications and fees. It does not lock a price, hold inventory or create a reservation. The price keeps falling while you read.

2.6 One package per Drop. Each Drop is for one travel package. Once held, it is unavailable to other customers and is removed from the live feed. A Sold at label on a held deal describes its locked price, not a completed payment.

2.7 End of a Drop. If no Hold is accepted before the duration ends, the price reaches the Floor and that Drop ends and is removed from the live feed. We may later run a new Drop for the same or a similar package. It has its own identity, starting price, Floor and duration; it does not reopen an earlier Drop.

3. Book Now and the price lock

3.1 First accepted request wins. The first Book Now request our server accepts locks the Drop’s current server price for that customer (a “Hold”). If requests arrive at nearly the same time, our server’s record decides which was accepted first, absent manifest error.

3.2 Five-minute guarantee. A Hold guarantees the locked price for five minutes, starting when our server accepts Book Now. The guarantee countdown is shown at checkout.

3.3 After the guarantee ends. At 0:00, the locked price is no longer guaranteed. Payment may still be available for a limited time under the existing reservation rules, at our discretion. This is not an additional guaranteed payment window. The server determines whether your reservation remains available; if it has ended, return to the auction to check current offers.

3.4 A Hold is not a purchase. A Hold, Sold at label or winning screen is not a completed booking. Your purchase is complete only when payment is successfully authorized or completed as required by Booksi and a booking confirmation is issued.

3.5 Unpaid Holds. If a Hold ends without completed payment, it is released and that Drop does not reopen. The package is not offered to another customer through that expired Hold. Existing Booksi reservation rules apply to any partial checkout. We may limit or suspend Book Now access for repeated unpaid Holds.

3.6 Your purchase is binding. Once payment is completed, you have agreed to buy the package at the locked price, subject to the cancellation and refund rights in the Offer Terms, Booksi Refund Policy and applicable law.

4. Eligibility and purchase limits

4.1 Read the qualifications before booking. Every Drop is a promotional package subject to its Offer Terms. You must meet that offer’s qualifications, which may include minimum age, household income, creditworthiness, attendance with a spouse or cohabiting partner, and a valid major credit card. The Drop price does not waive these requirements.

4.2 Resort preview. Where required by the Offer Terms, you must attend a resort preview of the length stated in those terms. Not completing the preview or not qualifying may result in the fee stated in the Offer Terms being charged. A low Drop price does not change any qualification, preview requirement or fee.

4.3 One purchase per customer. You may buy one Drop package per customer. We may use name, email, phone, payment card, address, device or household information to identify additional purchases, subject to the Booksi Privacy Policy. Additional purchases may be cancelled and refunded.

4.4 Your own details. Use your true name, contact details and payment method. You may not buy a Drop for resale. This does not limit any permitted transfer to another qualified guest under the Offer Terms.

5. Retail Value, savings and viewing counts

5.1 Retail Value. Retail Value is the comparison value supplied by Booksi or the resort developer for the same or a comparable package, considering destination, accommodation type and length of stay, without the resort preview promotion. It is a reference point, not a promise that the package has previously sold at that price. Displayed savings compare the Drop price with that stated Retail Value.

5.2 Floor price. The published Floor is the lowest price for that Drop. A Drop is not sold below its Floor, and its Floor is not changed after it starts.

5.3 Prices vary between Drops. Different Drops for the same or similar packages may have different Retail Values, Floors, durations and final prices. Another customer’s lower price does not create a right to a price adjustment, without limiting rights under applicable law.

5.4 Viewing counts. The currently displayed viewing badges use simulated counts between 7 and 24. They are illustrative, not verified live viewer counts or evidence of actual demand. They do not affect the server price, the Drop duration or which Book Now request is accepted.

5.5 What the price includes. The Drop price covers only the package described in the Offer Terms. Activation fees shown at checkout are additional to the locked Drop price. Resort fees, reservation deposits, taxes, optional add-ons and travel costs apply as disclosed in the Offer Terms and checkout. Prices and payments in this application are in USD; this checkout does not convert the auction price into another currency.

6. Errors, outages and fair use

6.1 Pricing and listing errors. If a Drop contains an obvious error, such as an incorrect Retail Value, Floor, duration, property or description, or a fault produces a price that does not match the published formula, we may cancel the affected Drop, Hold or purchase and refund any amount paid in full. We will notify you using your supplied contact details.

6.2 Outages and interruptions. A website, server or payment-provider fault may cause a Drop to end or become unavailable. Where an accepted Hold cannot be paid because of a fault on our side, we will honor the locked price or refund amounts paid in full, at our choice and subject to applicable law. We are not responsible for failures of your device, browser or connection. A later replacement Drop is a separate offer, not a reopening of an expired Hold.

6.3 Prohibited conduct. Do not use bots, scripts, automated tools, multiple browsers or accounts to gain a timing advantage; interfere with, reverse-engineer or overload the website or pricing server; create Holds with no intention of paying; supply false identity, contact or payment details; or coordinate with others to manipulate or block a Drop.

6.4 Our response. If we reasonably believe you breached the eligibility or fair-use rules, we may cancel your Hold or purchase, issue refunds subject to the Offer Terms and applicable law, and suspend access to future Drops.

6.5 Our records. Our server records of prices, timestamps and accepted Book Now requests are the record of what happened in a Drop, absent manifest error.

6.6 Changes. We may withdraw an unheld offer or update these Drop Terms. Published Drop prices continue to follow their stored formula and Floor. The version posted when your Book Now request is accepted applies to that purchase; updates do not rewrite an existing Hold’s financial terms.

7. Payment, refunds and contact

7.1 Payment. Payment is due in full at checkout using a payment method accepted by Booksi and permitted by the Offer Terms. A purchase may be declined or cancelled if payment cannot be authorized. Optional upgrades are separate from the original Drop package and must be selected under their displayed terms.

7.2 Refunds. Buying through a Drop does not reduce your cancellation or statutory refund rights. Cancellation periods, state-specific rights, how to request a refund and any restrictions are governed by the applicable Booksi Offer Terms, Booksi Refund Policy and law. These Drop Terms do not replace or shorten those rights.

7.3 No price adjustments. Because prices fall by design, a lower price in the same or a later Drop does not by itself entitle you to a refund of the difference, without limiting your other cancellation or statutory rights.

7.4 Disputes and governing law. The dispute, governing-law and liability provisions in the applicable Booksi Terms and Conditions govern disputes about a Drop, subject to applicable law.
